The JobKeeper legislation has now been passed by Federal Parliament.
The legislation will receive Royal Assent today from the Governor-General and then will be in force.
However, it is important to note that there are still rules to be set by the Treasurer in terms of how the JobKeeper payment will work, including the the eligibility criteria for employers and employees. This leaves us to rely on the Treasury information as of 5 April until those rules are set.
What does this mean?
• Amendments to the Fair Work Act will be in place as soon as the JobKeeper legislation is given Royal Assent.
• Broadly speaking, the amendments allow eligible employers to give eligible employees “JobKeeper enabling directions” on certain terms of their employment, such as reducing their hours of work, duties or location, without the consent of the employee.
• The rules which set out eligibility criteria and how the JobKeeper payment will work are set to be finalised in the coming days. This leaves us to rely on the Treasury information as of 5 April until those rules are set, so there is a possibility that the Treasury information we have already received could change.
